O R D E R :-
In the G.O. 1st read above, the Government
have issued orders for counting the services of the (45) retired employees of
A.P. Yogadhyayana Parishad, rendered prior to 16.03.1991 i.e., from the dates
of their appointment, as qualifying service for pensionary benefits, as per the
terms and conditions of A.P. Yogadhyayana Parishad, established under Act, 25
of 1987, subject to paying back the Government share of the Contributory
provide fund along with interest thereon by the employees.
2. In the G.O 2nd read above, the Government
have issued orders for counting the past services of (42) employees of A.P.Y.P
rendered prior to 16.03.1991 i.e. from the date of their appointment as
qualifying service for pensionary benefits as per the terms and conditions of
A.P. Yogadhyayana Parishad established under Act’ 25 of 1987 subject to
condition that the employees should pay the Government share of Contributory
Provident Fund along with interest thereon.
3. Sri K.Ramakrishna and other employees of
A.P. Yogadhyayana Parishad also have filed O.A.No.8618/2013 before the Hon’ble
Andhra Pradesh Administrative Tribunal to direct the respondents, to extend the
benefit of counting their past services prior to 16.03.1991 for the pensionary
benefits, as was extended to other similarly situated employees of A.P.
Yogadhyayana Parishad and its units vide G.O. 1st and 2nd read above. The
Hon’ble Andhra Pradesh Administrative Tribunal has passed the following interim
orders on 10.12.2013. “ Pending further
orders, the applicants are at liberty to
make their representations to the respondents claiming the benefit of counting
their post service as was extended to other similarly situated employees, who
are covered under G.O.Ms.No.279, HM&FW (R.1) Dept., dt: 13.10.2010 and
G.O.Ms.No.212, HM&FW (R.1) Dept., Dt: 01.09.2012 within ten days from today
and thereafter, the respondents are directed to consider and pass appropriate
orders on the representations of the applicants keeping in view of the
G.O.Ms.No.279, HM&FW (R.1) Dept., Dt: 13.10.2010 and G.O.Ms.No.212,
HM&FW (R.1) Dept., Dt: 01.09.2012 within a period of four weeks
4. In compliance with the directions
of Andhra Pradesh Administrative Tribunal, the Commissioner of AYUSH has
furnished proposals while enclosing a list of (45) employees of institutions as
per G.O.Ms.No.157, HM & FW (R1) Department, dated:16-5-2003, who have
retired from service and requested for counting their service prior to
16-3-1991 i.e from the dates of their appointment as qualifying service for pensionary benefits,
as per the terms and conditions of A.P. Yogadhyayana Parishad established under
the Act 25 of 1987, subject to condition to pay the Government share of the CPF alongwith
interest thereon by the employees.
5. Government after careful
examination of the matter and keeping in view of the orders of Hon’ble Andhra
Pradesh Administrative Tribunal hereby order that the past service of forty
five (45) employees of AP Yogadhyayana Parishad (shown at Annexure to this G.O)
including the (29) applicants in O.A.No.8618/2013 rendered prior to 16-03-1991
i.e from the date of their appointment,
shall be treated as qualifying service for pensionary benefits, as per the
terms and conditions of A.P. Yogadhyayana Parishad established under Act 25 of
1987, subject to condition that the employees should pay the Government share
of Contributory Provident Fund alongwith
interest thereon.
6. The Commissioner of AYUSH and
Secretary, A.P. Yogadhyayana Parishad shall take necessary action
accordingly.
7. This Order issues with the
concurrence of Finance (Pen.I) Department vide their U.O.No.443/06/A.1/Pen.I/14,
Dated 25.01.2014.
