Sri Late. S.Arun Kishore Babu, Senior Accountant (Retd.), was one of the accused in the case of misappropriation of Government funds for a tune of Rs.1.93 crores by the Junior Assistants of the Office of the Sub–Registrar, Sattenapalli and
Pedakurapadu of Guntur District.
2. In the reference1st read above, the Director of Treasuries and Accounts, Andhra Pradesh Hyderabad initiated disciplinary proceedings against Sri Late S.Arun Kishore Babu, Senior Accountant (Retd), for the following procedural lapses;
1. For not keeping the specimen signatures of Sub – Registrar Sattenapalli.
2. For not informing the adjustment of surcharges to the Sub–Registrar.
3. Accepting the letter of authorization received from Sub -Registrar without knowledge of Sub Treasury Officer.
4. For passing the antedated cheques furnished by the Ex-Sarpanch.
5. For admitting the cheques irregularly.
3. In the reference 2nd read above, the Director of Treasuries and Accounts, Andhra Pradesh Hyderabad awarded a punishment of stoppage of one annual
grade increment without cumulative effect in respect of Sri Late S.Arun Kishore Babu, Senior Accountant (Retd), as per the procedure prescribed under Rule 14 of APCS (C&A) Rules, 1991.
4. In the reference 3 read above, Government ordered for an inquiry by the CBCID. The CBCID has investigated the case and filed charge sheet in VI Additional Munsif Magistrate Court, Guntur. While the matter stood thus, Sri S. Arun Kishore Babu, Senior Accountant (Retd), expired on 06.12.2011.
5. Consequent on above, in the reference 4th read above, the Hon’ble VIth Additional Junior Civil Judge, Guntur in Orders dt.21-11-2012, abated Late Sri. S.Arun Kishore Babu, from Criminal Proceedings in CC.NO.11/2007 & 19/2007.
6. In the reference 5th read above, the Director of Treasuries and Accounts, Andhra Pradesh, Hyderabad has stated that the charged officer, Sri. S.Arun Kishore Babu, Senior Accountant (Retd), Sub–Treasury, Sattenapalli, Guntur
District, expired on 06-12-2011 and furnished the Xerox copy of the Death Certificate of Sri. S.Arun Kishore Babu, Senior Accountant, (Retd.) and requested the Government to issue necessary orders in the matter, to enable the Director of
Treasuries and Accounts, Andhra Pradesh, Hyderabad to sanction the Family Pension and other pensionary benefits to Smt. S.Deevena wife of Late Arun Kishore Babu, Senior Accountant (Retd.).
7. According to Sub-Rule 7(a) under Rule 9 of Andhra Pradesh Revised Pension Rules, 1980, “when a Government servant dies before conclusion of the disciplinary proceedings, generally death abates all further proceedings. As such, when Government servant dies before conclusion of the disciplinary proceedings, the proceedings under Rule 9 of the Andhra Pradesh Revised Pension Rule, 1980 also abates.
8. Government, after careful consideration of the matter, hereby order that the Criminal and the Disciplinary Proceedings initiated against Late S. Arun Kishore
Babu, Senior Accountant (Retd), Office of the Sub–Treasury, Sattenapalli, Guntur District, be abated under Rule 9 (7) (a) of Andhra Pradesh Revised Pension Rules, 1980 and sanction pensionary benefits to his wife Smt. S.Deevena.
9. The Director of Treasuries and Accounts, Andhra Pradesh, Hyderabad shall take necessary further action in the matter accordingly.
