ORDER:
In the representations 9th read above, the Secretary and
Correspondent, of (1) Bellamkonda Sudha School of Nursing at Giddalur, Prakasam
District (2) Bellamkonda
Sudha School of Nursing at Cumbum, Prakasam District and (3) Laxmi Srinivasa School of Nursing at
S.P.Nagar, ECIL ‘X’ Roads, Keesara Mandal, Ranga Reddy District has submitted that Sri Bellamkonda Sayanna Educational and Rural
Development Society Hyderabad had applied for establishment of above mentioned
three Schools of Nursing in response to
the notification issued by the then Chairman, Selection Committee for Para
Medical Institutions (SCPMI) headed by Justice (Retd.) G. Radha Krishna Rao,
which was existing prior to the High Power Committee headed by Justice (Retd.) I. Pandu Ranga Rao. As per the then
existing procedure, particulars furnished in respect of proposed above Nursing
schools were got verified by the Principal/Nursing Tutor-Grade.I, School of
Nursing, Government General Hospital, Kurnool along with Nursing Tutor-Grade.II,
School of Nursing, Government General Hospital, Kurnool and after getting
satisfied with the physical and clinical infrastructure, applications were
issued to apply for establishing the above three Schools of Nursing. The
special inspection teams inspected the schools and based on their report the
Director of Medical Education forwarded report to the Government for issue of
Essentiality Certificates. Further, as
per the instructions of the Government the District Level Teams again inspected
the above three schools and forwarded their report to the Government for issue
of Essentiality Certificate. However, their
applications were rejected by the Chairman, High Power Committee citing G.O.Ms.
No.321, HM&FW (K2) Dept., dt.05.08.2006, wherein it was decided and ordered
that ‘No Essentiality Certificate / Permission for establishment of Nursing
Schools shall be issued. At this
juncture the Indian Nursing Council has taken a temporary decision to stop
permission to new School
of Nursing and based on
the said decision of the Indian Nursing Council in the state of Andhra Pradesh
and hence their proposals were pending in the Government since 2006. Further, the Indian Nursing Council has
reviewed the earlier taken policy decision and issued orders permitting the state
Government to accept proposals for starting of New School of Nursing in view of
NRHM policy and further vide G.O. Ms. No.47, HM&FW (K2) Department,
Dt.04.03.2011 the Government permitted two schools of Nursing ie. (1) Deepthi
School of Nursing, Nalgonda (2) Mother Theresa School of Nursing, Miryalaguda,
Nalgonda District. The Secretary and
Correspondent of (1) Bellamkonda Sudha
School of Nursing at Giddalur, Prakasam District (2) Bellamkonda Sudha School
of Nursing at Cumbum, Prakasam District and (3) Laxmi Srinivasa School of
Nursing at S.P.Nagar, ECIL ‘X’ Roads, Keesara Mandal, Ranga Reddy District had
therefore requested the Government to look into matter and issue orders /
Essentiality Certificates to start the above said three Schools of Nursing.
2. In the letters 10th
read above, a copy of the representations of the Secretary and Correspondent of
(1) Bellamkonda Sudha
School of Nursing at Giddalur, Prakasam District (2) Bellamkonda Sudha School
of Nursing at Cumbum, Prakasam District and (3) Laxmi Srinivasa School of
Nursing at S.P.Nagar, ECIL ‘X’ Roads, Keesara Mandal, Ranga Reddy District,
were forwarded to the Chairman, High Power Committee for his remarks in the
matter.
3. The Chairman, High Power Committee
Hyderabad in his letters 11th read above has stated that Bellamkonda
Sayanna Educational and Rural Development Society has submitted applications on date 30-10-2004 to accord
permission for establishment of (1) Bellamkonda Sudha
School of Nursing at Giddalur, Prakasam District (2) Bellamkonda Sudha School
of Nursing at Cumbum, Prakasam District and (3) Laxmi Srinivasa School of
Nursing at S.P.Nagar, ECIL ‘X’ Roads, Keesara Mandal, Ranga Reddy District in response to the notification issued by the
then Chairman Selection Committee for Para Medical Institutions headed by
Justice Shri Radha Krishna Rao. After
him Justice Shri I. Pandu Ranga Rao took over in the year 2005 as Chairman,
High Power Committee, the infrastructure of the applicant institutions were got
verified by the District Level team under G.O.Ms.No.448, HM&FW (K2) Dept.,
dated 25-4-2005 and G.O.Ms.No.848,
HM&FW (K2) Dept., dt.6-8-2005 and a report was received from the
authorities concerned stating that the institutions are having infrastructure required for admission
of 50, 60 and 50 students per annum. In the mean while, the Government have taken
a policy decision not to accord permission for establishment of Schools of
Nursing in the State of Andhra Pradesh and to upgrade the existing Schools of
Nursing as Colleges of Nursing by 2010 and issued G.O.Ms.No.164, HM&FW (K2)
Dept., dt.23-5-2005 and G.O.Ms.No.165, HM&FW (K2) Dept., dt.23-5-2005. Accordingly in the wake of the G.Os
Government have pleased to issue G.O.Ms.No.321, HM&FW (K2) Dept.,
dt.5-8-2006 to refund the inspection fee.
Accordingly, inspection fee was refunded to the applicant society.
4. The contention of the applicant
institutions are that though the Government have taken a policy decision not to
permit Schools of Nursing any further having issued G.O.Ms.No.164, HM&FW
(K2) Dept., dt.23-5-2005 and G.O.Ms.No.165, HM&FW (K2) Dept., dt.23-5-2005,
the Government went back from the said stand and have issued Essentiality
Certificate / No Objection Certificate in favour of two Schools of Nursing ie. (1) Deepthi School of Nursing, Nalgonda (2) Mother Theresa School of
Nursing, Miryalaguda, Nalgonda District already permitted vide G.O. Ms. No.47,
HM&FW (K2) Department, Dt.04.03.2011, along with number of other
institutions.
5. The
Chairman, High Power Committee, Hyderabad in his letters 11th read
above has recommended to start the following three Nursing Schools in respect
of Sri Bellamkonda Sayanna Educational and Rural Development Society :-

6. After careful consideration of the
matter and keeping in view of the recommendation of the High Power Committee
vide reference 11h read above, for the issue of Essentiality
Certificate/No Objection Certificate and also keeping in view the proceedings F.No.18-2 (Government ) 2005 of the Indian
Nursing Council, dt.31-3-2006, and in exercise of the powers conferred under
rule 38 under section 11 (2) (b) of Andhra Pradesh Nursing and Midwives
(Extension and Amendment) Act, 1964 and sub rule (iii) of rule 12 of Andhra
Pradesh General Nurse Training Institutions
(Admissions into General Nurse Training and Grant of permission to
Private Schools of Nursing) Rules, 1997 made under section 99 of Andhra Pradesh
Education Act, 1982, Government have decided to consider favourably
the request of the Secretary & Correspondent, Bellamkonda Sayanna
Educational and Rural Development Society, Hyderabad and accordingly hereby
accord permission to establish the (1) Bellamkonda Sudha
School of Nursing at Giddalur, Prakasam District (2) Bellamkonda Sudha School
of Nursing at Cumbum, Prakasam District and (3) Laxmi Srinivasa School of
Nursing at S.P.Nagar, ECIL ‘X’ Roads, Keesara Mandal, Ranga Reddy District , and to
start General Nursing & Midwifery (GNM) course of 3 ½ years duration with clinical attachment from
the academic year 2012-13, as follows:-

7. The Permissions accorded in para ( 6 )
above, is subject to the following conditions:-
(i) The
annual intake of students should not exceed as mentioned above and the
institutes should fulfill and abide the rules and regulations notified by
Government in G.O.Ms.No.313, HM&FW (M2) Department, dated.18-8-1997,
G.O.Ms.No.139, HM&FW (M2) Dept., dated.14-5-1998 and G.O.Ms.No.75,
HM&FW (K2) Dept, dated. 28-03-2003 and amendments issued thereon from time
to time.
(ii) The
Educational Society should pay Annual registration fee of Rs.20,000/- to APVVP,
Hyderabad before starting counseling of students and this
should be verified by the DCHS concerned. The Institute should also pay
a fee of Rs.1,000/- (Rupees one thousand only) or as may be ordered by Government
towards renewal of recognition of Private School of Nursing for every 5 years
to the Commissioner, A.P. Vaidya Vidhana Parishad or such office as may be notified
by Government.
(iii) The proposed Private Nursing Schools shall fulfil
all the conditions as prescribed by the Government in the final orders issued,
before establishing the institution within a period of one year from the date
of issue of orders of Government. In case, the Educational Society fails to fulfil
the conditions or fails to start the course within a period of one year, the permission will be cancelled.
8. The aforesaid Educational Society
should also follow the following instructions scrupulously:
(i)
The
Institutes should run regularly with the required infrastructural facilities,
equipments, teaching staff, non-teaching staff, office rooms and clinical
facilities, hostel facility, library books as prescribed by Indian Nursing
Council, New Delhi, Andhra Pradesh Nursing and Midwives Council, Hyderabad or Government
from time to time and should run in the best interests of students. The
Institutions will be inspected by an inspecting officer appointed by Government
or APNMC, INC, New Delhi
from time to time.
(ii)
The students hostels, wherever provided are
adequately furnished with appropriate areas for their comfortable stay and
provision is made for their indoor or outdoor games.
(iii)
The
procedure prescribed by Government or Indian Nursing Council, New Delhi, Andhra
Pradesh Nursing and Midwives Council Hyderabad/ Director of Medical Education
for the selection and admission of students, collection of fees, rule of
reservation, local – non local areas,
conducting examinations should be scrupulously
followed.
(iv)
The selection of candidates against free
seats in the course should be done by the Selection Committee headed by the
Joint Collector of the concerned district as specified in
G.O.Ms.No.313,HM&FW(M2)Dept.,dated:18.08.1997 / G.O.Ms. No.139, HM&FW
(M2) Dept., dated.14-5-1998 and as amended from time to time.
(v)
The Institutes should not have or open
branches on the same place or elsewhere in the State or out side the State.
9. The
permissions granted in para (6) above is liable for cancellation whenever the
Government / Indian Nursing Council, New Delhi, Andhra Pradesh Nursing and
Midwives Council, Hyderabad/ Director of Medical Education forms the opinion
based on an inspection report that the aforementioned Educational Society is
not running the Schools in the best interests of the students or commits any
irregularity or violates any of rule or regulation, after giving 15 days notice
to the Educational Society to show cause, against the proposed cancellation and pass appropriate orders after
considering the explanation, if any, offered by the Society against the show cause
notice.
10. The
Registrar, Andhra Pradesh Nursing and Midwives Council, Hyderabad shall
communicate the final decision of acceptance or rejection of affiliation and
recognition to the aforementioned Educational Society, as the case may be within
a period of two months from the date of issue of this order after detailed and
careful verification of all material facts and having satisfied fully that an
statutory requirements for establishment of GNM School are fully met.
11. The Registrar, Andhra Pradesh Nursing and
Midwives Council, Hyderabad and the Director of
Medical Education, A.P., Hyderabad
shall take necessary action in the
matter accordingly.
